Acknowledgement of Risk and Waiver and Release of Liability

In consideration of my use of the Blue Ridge Club, Inc.'s ("Blue Ridge") swimming pool (the "Pool") - for lap swim, swim lessons, open swim, or otherwise - I hereby forever release and covenant not to sue Blue Ridge and its officers, directors, employees, instructors, volunteers, and agents from any and all present and future claims, including without limitation claims for negligence, property damage, personal injury, and/or wrongful death, arising as a result of my use of the Pool and any and all activities, and/or exposures to COVID-19, incidental thereto. 

I further voluntarily waive and relinquish any and all claims against Blue Ridge and its officers, directors, employees, instructors, volunteers, and agents, including without limitation claims for negligence, property damage, personal injury, and/or wrongful death, arising as a result of my use of the Pool and any and all activities and/or exposures to COVID-19 and other infectious diseases incidental thereto, that may be made by me and/or my family, heirs, estate and/or assigns. 

I further agree to indemnify and hold harmless Blue Ridge and its officers, directors, employees, instructors, volunteers, and agents from any and all present and future claims, including without limitation claims for negligence, property damage, personal injury, and/or wrongful death, arising as a result of my use of the Pool and any and all activities, and/or exposures to COVID-19, incidental thereto. I further agree to assume all financial responsibility for any losses my actions cause due to my use of the Pool. 

I hereby acknowledge that my use of the Pool involves certain risks, including but not limited to property damage, personal injury, and/or death. I further acknowledge that my use of the Pool involves activities incidental thereto, including without limitation the potential for negligent and/or reckless conduct of other users of the Pool. I also further acknowledge that an inherent risk of exposure to COVID-19 and other infectious diseases exists in any public place where people are present. I acknowledge, and hereby agree to accept, all risks and hazards associated with my use of the Pool, including potential exposure to COVID-19 and other infectious diseases. I further acknowledge my personal responsibility to take proper care in my actions and follow any and all safety rules and procedures established by Blue Ridge associated with my use of the Pool. 

I understand that this acknowledgement of risk, waiver, and release of liability is intended to be as broad and inclusive as permitted by the laws of the State of Washington, and I agree that if any portion is held invalid, the remainder will continue in full legal force and effect. I further agree that any legal proceeding arising under this agreement shall be governed by the laws of the State of Washington. If I am over 18 years of age, I affirm that I sign this agreement solely and freely. 

If I am under 18 years of age, my parent or legal guardian signs this agreement solely and freely. For participants under the age of 18, the parent or legal guardian who signs below also agrees to be bound by the terms and conditions of this agreement. I have read this agreement and fully understand that by signing below, I am giving up legal rights and/or remedies that may be available to me. I understand that this agreement is a binding legal document. I also sign this agreement on behalf of any other person(s) who is/are both a member of my household and of the Blue Ridge Club, and I do so with consent of such member(s) of my household.
